The Last Will and Testament of Peter Smith ser.

In the name of the Benovolent Father I Peter Smith senr. of Clinton County and State of Indiana, do make and publish this my last will and testament. Since Peter died in 1851, suggest you order the "complete" probate packet, and find out exactly where Abraham was to sign for his bequest. There might be a teeny bit of paper, the receipt receiving the bequest in the packet. It should state his address, and where he is signing. I hope you connect, need help in NC looking for Pete's ancestors.

1st I give and devise to my beloved children as follows:. that my son Abram Smith have six hundred dollars and that my daughter Ann wife of William (Said) have the sum of six hundred dollars and that my son Christian Smith have the sum of five hundred dollars and that my son Peter Smith have the sum of six hundred dollars and that my son Jacob Smith have the sum of six hundred dollars, and that my son Daniel Smith have the sum of six hundred dollars, and that the heirs of my son Moses Smith towit Silas Smith and Nancy Smith each have three hundred dollars, but not to be paid to them till they become of age and that my daughter Rebecca wife of Wiley Erby have the sum of six hundred dollars and that my son Joseph Smith have the sum of seven hundred and fifty dollars and that Benjamin Lilly have one dollar.

2d That the hereafter appointed executors are to pay my funeral expenses and also all just debts that I may owe at my death out of the money that may be on hand at my death and the remainder of money to be paid to the above named heirs in proportion to the amount willed to each of them, as soon as said executors may become in possession of it after my death and the remainder to be paid to said heirs out of the money collected from out standing debts or from the sale of the real estate as soon as collected.

3d In case the amount of my estate should be more than will pay the above amounts to the to the heirs and comfortably support my beloved companion during her lifetime the executors is to divide the same equally among all the said heirs (except the said Lilly he is to have only one dollar).

4th I do hereby nomionate and appoint Daniel Smith and Peter Smith executors of this my last will and testament hereby authorize them the said executors at my death to take charge and possession of all my propertyboth real and personal. I hereby authorizing and empowering them to compromise adjust release and discharge in such manner as they may deem proper the debts and claims due me. I do also authorize and empower them to sell by private sale or in such manner upon such terms of credit or otherwise as they may think proper all of my real and personal property and deed to purchasers to execute acknowledge and deliver in fee simple said executors are to sell my real estate within seven years at any time they think proper within that time and in case my companion is living at the time of sale the real estate is to be sold with her right of dower on the same.

5th the said executors are to see that my beloved companion Susanna Smith have sufficient amount of my estate to render comfortable during her lifetime. In testamony whereof I have hereunto set my hand and seal the fifteenth day of October in the year of our Lord 1851.

Codicil to the foregoing will.

Whereas I Peter Smith Sen. of Clinton County, Ind. did on the fifteenth day of October A.D. 1851, make thwe above my last will and testament of that day do hereby declare the following to be a codicil to the same. Whereas in my last will and testament aforesaid I did bequeath to the heirs of Moses Smith to with Silas Smith and Nancy Jane Smith the sum of three hundred dollars each I do hereby revoke that portion of said will and give and bequeath said six hundred dollars (that was willed to said heirs) as follows towit that my companion Susanna Smith have five hundred dollars to be disposed of as she may see proper and that my esteemed friends Henry Smith and James M. Smith each have the sum of forth dollars and also that George W. Webb and Emily Smith each have the sum of ten dollars all of which is to be paid to them by my appointed executors in the manner that they are to pay the heirs in my will directed and also that said hers of Moses Smith towit Silas Smith and Nancy Jane Smith each have one dollar to be paid by the executors when they become of age.

Abraham's family moved to Switzerland, Indiana in 1814. Elander/Eleanor's family moved there in 1804. Here they became acquainted and friendship ripened into love, and the marriage was celebrated in 1815. They remained in Switzerland County, Indiana until 1833, and here their seven oldest children were born. In that year they emigrated to Hancock County, Indiana at which place the five youngest children were born. Mr. and Mrs. Smith made Hancock County their home until 1849 when they came to Henry County, Iowa locating near Rome. Here he bought 120 acres of raw land and developed a fine farm, residing here until his death in July 1871. Mrs. Smith died 3 August 1875. They were both members of the Methodist Episcopal Church at the time of their death, but had formerly belonged to the Baptist Church before coming to Iowa. They were devoted members of the society, and no couple in the county were more highly esteemed than they were.

Dear Brother, I take pen in hand to let you know that we are all well hoping that these lines may find you all well, now I will inform you that my son Jabeze and his family has left Greenfield, Indiana and came out here and is wintering here with us, and he likes Iowa very well so far as he has seen of it, and Peter is still in oragan and he rote to us that the indians is at war with the whites al through oragon he sais all the indians west of the rocky mountains have joined together, and they think goverment will have to send fifty thousand men to save orogan, now I will ---- your request conserning my money that is coming to me I want ou to send it by daniel to me, or any other person that is safe, and take their Receipt so as to make it safe to you, and as soon as i get the money i will send you a recet by mail and when you get it you can drop a line to me to let me know that you got it, unkel Isaac Limbacks'alfred was here to see us and he said it was not safe to send money by letter, if Brother daniel is coming out he can bring it to me and oblige me in so doing, and if no one comes from your part of the country that you can send it to me rite to me and i will try to send by someone for it, rite often and let us know how you all are getting along. prices products of the cattle, wheat $1.25 Corn .20 oats .20 potatoes .25 pork (85 or 5) Dollars per hundred, meat coffe 7 pounds to the Dollar shugar 1 pounds to the Dollar molasses 50 cents per gallon butter 15 cents per pound, I close with Respects to you all.

Will of Abraham Smith:

In the Name of God, Amen. I Abraham Smith of Tippecanoe Twonship Henry County state of Iowa being of Sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make publish and declare this to be my last Will and Testament. That is to say first after all my lawful debts are paid and discharged the residue of my real estate I give and bequeath to Jabez Smith of Tippecanoe Township, Henry County and state of Iowa.

The said Jabez Smith Shall take good care and treat reasonably well Abraham Smith the executor of this Will and Elenor Smith his Wife, during their natural lives and shall pay the sum of one hundred dollars in legal currency to each of my heirs as follows:

Peter Smith, a stock-raiser and farmer residing on section 28, Marion Township was born July 12, 1830, in Switzerland County, Indiana and is a son of Abraham and Eleanor (Van Dorin) Smith, the former a native of North Carolina, born 19 May 1794, and the latter August 10, 1800 in Pennsylvania. The earlier years of Peter were spent in attending the common schools in the state of Indiana and doing his part of the farm work. Born upon a farm, the greater part of his life has been spent in peaceful avocation of a farmer. He remained with his parents until 1853, when he made the overland trip to California, where he remained but a short time, then went to Oregon, and for two years was there engaged in farming. Returning to California, for about fourteen months he engaged in mining, and then went to freighting in California, Oregon, Idaho, and Washington Territory, but later engaged in stock-raising in Oregon, and for a time in merchandising. He was very successful in the far West, remaining there until 1868, when he returned to Henry County and purchased eighty acres of land, a portion of the farm on which he now resides. In 1883 he bought ninety acres more, making 170 acres, which is now under a fine state of cultivation. Mr. Smith is a successful stock-raiser, his stock consisting principally of fine Poland China hogs and Durham cattle. Everything that he made was by his own industry. On the 26th of April, 1869, Mr. Smith was united in marriage with Miss Lucy B. Crew, daughter of Walter and Sarah (Rice) Crew. She was born Aug 18, 1844, near Richmond, Virginia. Five children have been born to them...Mrs. Smith is a member of the Society of Friends. In politics he is a Democrat. As a citizen he stands high in the estimation of all. He is always ready to advance any interest for the public good.

Peter J. Smith

We were greatly surprised to learn of the sudden death of Peter J. Smith, which occurred Sunday morning, April 12, 1903, at his home west of town. It was but a few days ago that he was a pleasant caller at the Free Press office, giving us all a pleasant friendly greeting. He seldom came to town that he did not make us a visit and for many years our business relations, as well as social relations, have been very pleasant.

P.J. Smith was born in the state of Indiana, July 12, 1830. He was therefore in the 73rd year of his age at the time of his death. In 1853, Mr. Smith, the 23 years of age, made the overland trip to California. From there he soon after went to Oregon and engaged in farming. Next he returned to California and for more than a year ws engaged in mining. He next engaged in freighting in California, Oregon, Idaho and Washington Territory. Later he settled in Oregon and interested himself in stock raising and then in merchandise. After fifteen years thus employed in the far West, he came to Henry county in 1868 and purchased a farm in Marion township, where he lived many years.

Mr. Smith was married to Miss Lucy B. Crew April 26, 1869. This twain had five children born to them, three of whom are now living.

Mr. Smith had the respect and esteem of all who knew him. He was intelligent, well informed on all current topics, conscientious in his relation to others, industrious and in all respects reliable. The family have the sympathy of friends and Mrs. Smith, the bereaved widow, is a member of the Society of Friends and after the funeral the remains were taken to Salem for interment.

Mrs. Lucy Smith Dead

Well Known Resident Passed Away Sunday Morning

Death claimed Mrs. Smith Early Sunday After Long Illness with Heart Disease. Funeral Tuesday.

Mrs. Lucy B. Smith and aged resident of our community passed away at her home southwest of the city at four o'clock Sunday morning. She had been a sufferer with heart disease for the past four months so that her death was not entirely unexpected. Deceased was the wife of the late Peter J. Smith who passed away a number of years ago. Two children are left to mourn, Charles Sydney and Mamie Jane.

Funeral services will take place Tuesday, a short service to be held at the home at ten o'clock followed by services at Salem at two. Interment will be in Salem.

In the early 1860s Marcus went prospecting with brother, Hiram via wagon train in Idaho and was gone for two years. With the gold he brought back he bought a farm in Round Prairie vicinity of Jefferson County,IA. Marcus made the brick to build the house and brought the stone for the window sills and wall from the White's home.

The Smith's were a musical family, and with daughter, Martha, playing the organ spent evenings singing.

Old Resident Passed Away

Pioneer Resident of the Township Dies at His Home Monday Morning.

Mark Smith, one of the oldest residents of this place died Monday morning after an illness dating back into February. He was born in Hancock, Ind., March 13, 1831.

The funeral took place Wednesday and was largely attended.

The remains were interred in Lambert (sic) cemetery.

In 1819 he was united in marriage to Miss Rachel White. Ten children were born to them who are:

Mrs. Ella Tilford, Salem; Mrs Emma Cheesum [sic Chezum), Stockport; Mrs. Josephine Garretson, Beaver, Nebraska, Mrs. Arminta Lawrence, Mt. Pleasant; Mrs. Lucy Watkins of Lockridge; Mrs. Martha Litton of Glasgow; Antha Smith of Glasgow; Frank Smith of Stockport and Charles and George Smith of Lockridge.

Mr. Smith and family have resided near Lockridge for many years and a large circle of friends will deeply sympathize with the surviving relatives.

A VEGA WEDDING

Vega, Dec. 30 (Correspondence)-Mr. Frank M Smith and Miss Ella M. Johnson, were united in marriage at the home of the bride's parents near Vega, Dec. 29. At 6 p.m. the bride and groom took their places, attended by Mr. C.W. Hutchinson as best man, and Miss Hannah Nelson as bridesmaid. Rev. J. Lee after a brief ceremony pronounced them husband and wife. Miss Mattie Smith played on the organ while Mrs. Jennie Johnson sang "Beneath the Low Thatched Roof." The bride was dressed in cream colored gloria silk, trimmed in blue and white slippers, the groom in black.

The presents were numerous and valuable, consisting of most articles needed in housekeeping, from a clock to a butter knife. About sixty guests united in congratulations and dined at the well prepared wedding feast. All decided that Mr. and Mrs. Johnson knew what good things were required for such an occasion. After the feast some time was passed in singing and instrumental music.

The next day the parents of the groom, Mr. and Mrs. Mark Smith, entertained at dinner quite a number of invited guests.

The happy young couple will go to housekeeping at once in a new residence near the home of the father of the groom, where the family has resided for many years while their many friends predict for them a prosperous future.

Charlie Smith was a farmer near Lockridge, Iowa.

We three granddaughters-Ruth, Helen and Vivian, have fond memories of many days spent at their farm and of all the great cooking Grandma did on a cook stove fueled by wood. She could make the best hot rolls for miles around. A railroad track went through their farm, so spent many days waving at the engineer. Played in the haymow with the baby kittens and jumping in the hay. They had no car, so looked forward to the neighbors taking them to Lockridge to get groceries on Saturday night. We would sit on a bench in the store and listen to the adults visit. Then in the winter we would sleep upstairs (no heat up there) and take a warm heating stone to bed with us. Very good memories of this Grandpa and Grandma Smith.

Monday, Jan. 29, 1951:

Mr. and Mrs. Charlie C. Smith, two life-long Jefferson County residents, will observe their golden wedding anniversary Tuesday, January 30. All the fifty years of their marriage were lived within a radius of three miles of Lockridge, until 1947 when they moved to their present home at 600 S. Third St.

Due to illness in the family no open house celebration is planned. A family dinner honored the couple Sunday noon in the home of their daughter, Mrs. Retha Kessel, north of town. Their three children were in attendance, including Orril Smith of near Lockridge; and Cecil Smith of Davenport.

Mrs. Smith is the former Nellie Crane, daughter of Mr. and Mrs. Charlie Crane, pioneer settlers of the Glasgow community. Mr. Smith's parents, Mr. and Mrs. Marcus Smith, were also early settlers east of Glasgow. The wedding was solemnized at an evening ceremony January 30, 1901, in the home of the bride's parents then living near Kilbourne. As was the custom of the period, the infair was held the following day in the home of the bridegroom's parents, east of Glasgow.

Mrs. Smith was born in 1879 and will be 72 April 5. Mr. Smith, born in 1876 will observe his 75th birthday, March 18. Both are in fairly good health.

They have three granddaughters, Mrs. Raymond Stagg (Ruth Kessel) of Kansas City, Missouri; Mrs. Rex Leeper (Helen Kessel) of Packwood; and Vivian Kessel, north of town; and one grandson, Charles Lee Smith of Lockridge. All the children and grandchildren were present for the family dinner with the exception of the Staggs of Kansas City. A gold and white theme was used for the table decorations; with a large anniversary cake, appropriately inscribed, as the centerpiece.

Charlie Clark Smith, 85, long time resident of Jefferson county, passed away about 12:45 p.m. Monday at the home of his son, Orril Smith, who resides three miles southwest of Birmingham.

Smith had made his home with his son since 1957 and had been in failing health for the past three months.

Last rites will be Thursday at 2 p.m. at the Weston Behner Funeral home with the Rev. D.O. Van Dyne in charge. Burial will be in Lambirth cemetery near Glasgow.

Charlie Clark Smith was born March 18, 1876, at Glasgow, the son of Marcus and Rachael White Smith. He was married to Nellie Crane on Jan. 30, 1901, at Kilbourn, Iowa. She passed away July 23, 1957.

Smith had been a farmer all of his life and lived for many years near Lockridge. Upon retiring in 1947, Mr. and Mrs. Smith moved to Fairfield where they made their home until her death in 1957.

He is survived by two sons: Orril Smith, Birmingham; and Cecil Smith, Davenport; and one daughter, Mrs. George Nelson, Fairfield. Other survivors include four grandchildren, seven great grandchildren, two sisters, Mrs. Martha Litton and Iantha Metcalf, both of Lockridge.

He was preceded in death by his wife, parents, five sisters and four brothers.

Mrs. Charlie C. Smith, 78, lifetime resident of Jefferson county [Iowa], passed away about 3:05 a.m. today at the Briggs-Eskew Nursing home where she had been a patient for the past six months.

She had been in failing health for the past several years and in serious condition for the past few months.

Last rites will be at the Weston-Behner funeral home at 10 a.m. Thursday with the Rev. D.O. Van Dyne officiating. Burial will be in Lambert cemetery southeast of Glasgow.

Mrs. Charlie Smith was born April 5, 1879, at Glasgow, the daugher of Charlie and Susan Catcott Crane. She was united in marriage on Jan. 30, 1901, to Charlie Smith at Kilbourn. She was a member of the Union church east of Glasgow.

Mrs. Smith moved to Fairfield from the Lockridge community 10 years ago.

She is survived by her husband; two sons, Orril Smith, Birmingham; and Cecil Smith, Davenport; also a daughter, Mrs. George Nelson, Fairfield. She is also survived by four grandchildren; two brothers, William and Walter Crane, both of Mt. Pleasant; two sisters, Mrs. Orpha Kiger, Mt. Pleasant; and Mrs. Cora Cooper, Salem.

Here is my report and all papers in the claim for pension W.O. 786203 of Phoebe Lorinda Van Tassell as widow of William H. Dorman.

This case was sent to the field to determine whether the claimant's former husband was the soldier on whose service the claim was based, whether they were ever divorced, and whether she has contracted more than one remarriage since his death.

As far as I can learn the reputation of the witness who has testified before me is good. He seems to be an intelligent man and seemed to testify truthfully.

As to the death of William Dorman it seems like it is a case of "the captain told the mate, the mate told the crew, the crew told me, so it must be true" witness is not able to give me any data or any information relative to Dorman before he came to Bonanza, Colo. he says it was talked that Bill had a wife before he came to Bonanza nad that the girl was loose in her morals, and that he had another wife after he left Bonanza, but he cannot recall the places.

The attorney mentioned in now Judge Stephenson. I went to Ft. Morgan and he was holding court but I happened there wehn there was a ten minute recess and the judge came out and I interviewed him. As he is a judge I did not feel warranted in taking his deposition under the circumstances. All he could tell me was that he knew Bill Dorman lisped in his talk, and that he married a girl at Bonanza named Mary Casteel. he says that that marriage must have been about 1883. he says Dorman was just an everyday miner and that he thinks the Exchequer Mine was the last one he worked at. he says he has no idea as to where Bill Dorma came from, or where he went. The Judge says he does not remember ever hearing that Bill Dorman died or was killed in a mine. Judge Stephenson could refer me to no one except a man named Dobson who works for the Denver Gas and Electric Company. He says Dobson ought to remember Dorman.....

....The object in the case is to ascertain when and where Bill Dorman died, or if he is living to locate him...If Dorman cannot be traced and the marriage records show that he was actually living as late as 1883, it will be necessary to try and ascertain whether he and claimant were divorced. They evidently were not. It is shown that the claimant went through a marriage ceremony with Van Tassel in 1875. If Dorman was then living and undivorced her "marriage" to Van Tassell could not have been legal and as the Bureau has held in some cases that a remarried widow must sho that she was actually legally remarried, it will be a question of whether claimant was remarried to Van Tassell by common law after the removal of the impediment.

...Dorman was just called Bill Dorman and the Judge and Mr. Vance both tell me he was a sort of a joke. That he appeared simple in a way and lisped when he talked. he is not described as a drinking or gambling man. If there is much question as to whether the Bill Dorman at Bonanza was claimant's husband, the soldier, she might be asked later if he lisped. That would be a very good point as to identity, as other personal descriptions vary and never amount to anything... T. Quinn Jones, Special Examiner.

RUFUS VANTASSEL: Tuesday night at about 10 o'clock at his home in this place occurred the death of Rufus VanTassel. For several years Mr. VanTassel has been afflicted with a number of diseases incident to old age. He was a man of about 70 years of age, and was a resident of this place about 15 years. Grant Strieby married Hannah McCoy Helsel in Columbia City IN. Nov. 19 1901. Shortly after this marriage, Ralph and Herbert were put into a "home". Our efforts to locate this home have had no sucess, as Grant lived in many counties working as a tailor and many home records are not in existance anymore.

We do not know what happened to Ralph. My grandfather Herbert never mentioned him and we assume that Ralph died young. Herbert ran away from the home about 10 years of age and went to IL.

Fairfield-Mrs. Bessie A Martin, 77, of 806 W. Hempstead, was found dead at home early Sunday morning. She had been in failing health for several years.

Born May 31, 1887, at Mankato, Kansas, she was the daughter of Rufus and Phoebe Smith VanTassel. She married John E Martin, who died in 1949. Mrs. Martin was a long time Fairfield resident. Nieces and nephews survive. Besides her husband, she was preceded in death by a son, three brothers and a sister.

The service will be Tuesday at 1:30 p.m. at the Weston Behner Funeral Home with the Rev. Donald L. Hickman, pastor of the Four Square Church, officiating. Burial will be in Maple Hill cemetery, east of Birmingham.

SIMON P. IRBY, ex-soldier and farmer of Forest township, Clinton county, Ind., is of sturdy Anglo-Saxon stock, his great-great-grandfather, Joseph Irby, having come from England in company with his brothers and made his settlement in Virginia. Joshua Irby, his son, and great-grandfather of our subject, was born in Vir-ginia and was a planter and slave-owner Charles Irby, grandfather of Simon P., was born in Virginia May 10, 1770, married Re-becca Lewis, and emigrated to Tennessee, where he reared a part of his family, then moved to Switzerand county, Ind., in 1827, and thence to Tipton county in 1850. Wylie R. Irby; the father of our subject and son of Charles Irby, was born in Tazewell county, Tenn., January 24, 1819, and married Rebecca Smith, daughter of Peter and Susanna (Lineback) Smith, and to their marriage had born the following children: Simon P., Eliza Ann, Columbus, Elizabeth J., Mary M., Joseph W., Lucinda C., Wylie R., Silas M., Rebecca S. and Matilda E. The parents of this large family are, now seventy-five and seventy-three years of age respectively. The father has been a deacon in the New Light church for many years, and is well read in the Scriptures. It is worthy of remark, incidentally, that not a nail was used in the erection of the first log cabin that Mr. Irby built on his present farm. Simon P. Irby was born in Switzerland county, Ind., December 2, 1842, and married Mary M. Suit, December 6, 1863. This lady is a daughter of Alexander and Abigail (Pike) Suit, the former of whom was an early settler and a renowned hunter of Clinton county; he was also a pioneer school-teacher and a farmer; he was twice elected township trustee on the democratic ticket, and was a deacon in the New Light church. After their marriage Simon P. Irby and wife lived for some time on a farm in Tipton county, and have been living twenty years on their present farm of eighty-two acres of very fertile land, which they have realized through their joint industry and economy clearing and improving nearly the whole of it. To the marriage of Mr. and Mrs. Irby five children have been born, in the following order: Lewis S., John A , Lucinda A., Isaac M. and Harvey A. Mr. Irby enlisted Novem-ber 2, 1864, in company B, Fortieth Indiana volunteer infantry, and fought in the campaigns of Kentucky, Tennessee, Missouri, Arkansas, Mississippi, Louisiana, Texas and Alabama, the most prominent battles in which he took part having been those of Columbia, Spring Hill, Franklin, Nashville, and the seven days' fighting in pursuit of Hood. He was honorably discharged November 13, 1864, and is now a member of H. C. Coulter post, No. 131, G. A. R. He and wife are members of the Christian church, in which he is a deacon. Lucinda A. Irby, the third child born to Simon P. and his wife, married James H. Jones, who is now deceased, and became the mother of the famous Jones twins. These children were united, like the renowned Siamese twins, Chang and Eng, by a cartilagenous tissue: they were strong and healthy, lived many months, but were attacked by the measles, then the bronchitis, and so perished.
